Terms of sale

This English translation is provided for convenience. The original French version (CGV) is legally binding in case of dispute.

These Terms of Sale ("Terms") govern all transactions on www.bugnazet.fr by SAS http5000 (Maison Bugnazet), registered office at Chez Le Petit Musée du Vin, 3 rue Passet, 69007 Lyon — SIRET 431 903 376 00033 — VAT FR 48 431 903 376.

Article 1 — Purpose and acceptance

These Terms govern the sale of wine, spirits and derivative items (posters) on bugnazet.fr to adult customers acting as consumers. Any order implies full acceptance of these Terms.

Article 2 — Protection of minors and public health

Pursuant to article L. 3342-1 of the French Public Health Code, the sale of alcohol to minors under 18 is strictly prohibited. By placing an order, the buyer expressly confirms they are 18 or older. An ID check may be requested at delivery.

Alcohol abuse is dangerous for health. To be consumed in moderation.

In accordance with article L. 3322-2 of the French Public Health Code, we draw consumers' attention to the fact that drinking alcohol during pregnancy, even in small amounts, can have serious consequences for the child's health.

Article 2 bis — Composition and labelling (wines)

In accordance with EU Regulation (EU) No 1169/2011 on food information for consumers and EC Regulation (EC) No 607/2009, our wines contain sulfites (SO₂ — sulfur dioxide), used as a preservative and antioxidant.

Article 3 — Essential characteristics of products

Essential characteristics of each product (cuvée, appellation, vintage, volume, alcohol content, price) are described on each product page. Photographs aim to be as close as possible to reality but are not contractual.

Article 4 — Prices

Prices are quoted in euros, all taxes included (French VAT 20% and alcohol excise duties included), excluding shipping. Shipping costs are specified before order validation.

Maison Bugnazet reserves the right to change its prices at any time, with the understanding that the product will be billed at the rate in effect at the time of order validation.

Article 5 — Orders and payment

Payment is made by credit card via the secure Stripe platform (Visa, Mastercard, Apple Pay, Google Pay). The order is definitively validated upon payment acceptance.

All transactions are secured by SSL encryption and compliant with PCI-DSS. Maison Bugnazet does not store any banking data.

Article 6 — Delivery

Times

Pursuant to article L. 216-1 of the French Consumer Code, orders are shipped within a maximum of 30 days following payment validation, and generally within 2 to 5 working days.

Transport risks

Risks pass to the buyer at delivery. Any anomaly (damaged parcel, broken bottle) must be reported to the carrier on receipt and notified to info@bugnazet.fr within 48 working hours with photos.

Article 7 — Right of withdrawal

Pursuant to articles L. 221-18 ff. of the French Consumer Code, you have a period of 14 days from receipt of your order to exercise your right of withdrawal, without having to justify your decision.

You may notify your decision using the withdrawal form or by sending any unambiguous statement to: info@bugnazet.fr.

Return conditions

Wine being a sensitive product, only unopened bottles can be refunded:

Any bottle opened or damaged by the customer cannot be refunded.

Return costs

Return shipping costs and risks are the buyer's sole responsibility. We strongly recommend taking out carrier insurance — broken bottles during the return trip will not be refunded.

Refund

Refund is processed within 14 days of receipt of the returned goods, by the same payment method used for the order.

In accordance with articles L. 612-1 ff. of the French Consumer Code, the customer has the right to refer the matter free of charge to a consumer mediator in the event of a dispute.

Article 12 — Applicable law

These Terms are governed by French law. Any dispute relating to their execution shall be exclusively brought before French courts, subject to mandatory provisions more favourable to the consumer.
